Datenschutzerklärung under the EU General Data Protection Regulation (GDPR) and the German TDDDG. This website is operated from Germany.

This site is run by one person, not a company with a data protection department. A data protection officer is not required by law in this case and has therefore not been appointed.

2. What this policy covers

This policy explains what personal data is processed when you visit thescenicguide.com, why it is processed, on which legal basis, how long it is kept and which rights you have. Personal data means any information relating to an identified or identifiable person, for example your IP address.

3. Hosting

This website is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. Hostinger processes data solely on my instructions as a processor under a data processing agreement pursuant to Art. 28 GDPR. The servers used are located within the European Union.

Legal basis: Art. 6 (1) (f) GDPR — my legitimate interest in a secure, stable and efficient presentation of this website.

4. Server log files

Each time this website is accessed, the hosting provider automatically collects and stores information that your browser transmits. This includes:

  • browser type and version
  • operating system used
  • referrer URL (the previously visited page)
  • host name of the accessing device
  • date and time of the server request
  • IP address

This data is not merged with other data sources and is not used to identify you personally. It serves the technical operation, stability and security of the website, in particular the detection and defence of attacks. Log data is stored only for as long as required for this purpose and is then deleted automatically.

5. SSL/TLS encryption

This site uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content. You can recognise an encrypted connection by the “https://” prefix in your browser’s address bar. When encryption is active, the data you transmit cannot be read by third parties.

6. Cookies and consent management

Cookies are small text files stored on your device. Some are technically necessary for the website to work, for example to remember your cookie preference or for caching. Others — in particular analytics cookies — are only used if you actively consent.

Consent is managed with the plugin Complianz (Complianz B.V., Netherlands). Complianz runs on my own server; no data is transmitted to Complianz. Your choice is stored locally in your browser and logged as proof of consent pursuant to Art. 7 (1) GDPR.

You can change or withdraw your consent at any time with effect for the future via the cookie settings link in the footer of this website. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal. A full overview of the cookies used can be found in the Cookie Policy.

Legal basis: § 25 (1) TDDDG in conjunction with Art. 6 (1) (a) GDPR for cookies requiring consent; § 25 (2) TDDDG in conjunction with Art. 6 (1) (f) GDPR for technically necessary cookies.

7. Google Analytics 4 (via Site Kit by Google)

Subject to your consent, this website uses Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). It is integrated through the WordPress plugin Site Kit by Google.

No cookies are set and no data is sent to Google before you give your consent. Google Consent Mode is active on this site: all consent signals — analytics storage, ad storage, ad user data, ad personalisation, functionality and personalisation storage — are set to “denied” by default for visitors from the EU/EEA, the UK and Switzerland. They are only switched to “granted” if you actively accept in the cookie banner.

If you consent, the following may be processed:

  • pages visited and time spent on them
  • clicks, scrolling and other interactions
  • referring source, for example Pinterest or Google Search
  • browser, device type, operating system, screen resolution
  • approximate location derived from a shortened IP address

IP anonymisation is active: Google shortens your IP address within the EU/EEA before any further processing, so it is never stored in full.

A data processing agreement pursuant to Art. 28 GDPR is in place with Google. Data may be transferred to Google LLC in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework, for which the European Commission issued an adequacy decision on 10 July 2023 (Art. 45 GDPR); in addition, EU Standard Contractual Clauses apply.

User- and event-level data is deleted automatically after the retention period configured in the Google Analytics property, at the latest after 14 months.

8. Google Search Console and PageSpeed Insights

Site Kit also connects this website to Google Search Console and Google PageSpeed Insights (Google Ireland Limited). Search Console shows me aggregated, anonymised statistics about how this site performs in Google Search — for example which search terms lead to the site. I cannot identify individual visitors from this data. PageSpeed Insights is used exclusively in the WordPress backend to measure loading speed; no visitor data is processed.

Legal basis: Art. 6 (1) (f) GDPR — legitimate interest in the technical and content-related optimisation of this website.

9. Fonts

This website uses fonts that are hosted locally on my own server (via the plugin OMGF). No connection to Google servers is established when you visit this site, and your IP address is not transmitted to Google for the purpose of loading fonts.

10. Website builder, caching and image optimisation

The pages of this website are built with Elementor and delivered using LiteSpeed Cache. Both run on the hosting server described above. LiteSpeed Cache may set technically necessary cookies and store page versions temporarily in order to speed up delivery. Images are optimised locally on the server; no image data is transferred to third parties for this purpose.

11. Contacting me by email

If you contact me by email, the details you provide — your email address, your name if given, and the content of your message — will be stored in order to process your enquiry and for possible follow-up questions. This data is not passed on without your consent.

Legal basis: Art. 6 (1) (b) GDPR where your enquiry relates to a contract or pre-contractual measures, otherwise Art. 6 (1) (f) GDPR. Your data will be deleted as soon as it is no longer required, unless statutory retention periods apply.

12. Purchases via Etsy

The travel guides are sold exclusively through my shop on the Etsy marketplace, operated by Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland. If you click a product link, you leave this website and Etsy’s own privacy policy applies from that moment. I receive from Etsy only the data required to deliver the product and to comply with tax and accounting obligations.

13. Newsletter

If you subscribe to the newsletter, I use the double opt-in procedure: after entering your email address you receive a confirmation email, and your subscription only becomes active once you click the link in it. Together with your email address, the date and time of registration and confirmation and the IP address used are stored, in order to prove that your consent was given.

The newsletter is sent via Hostinger Reach, a service of Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus, acting as processor under a data processing agreement pursuant to Art. 28 GDPR.

You can unsubscribe at any time using the link at the end of every newsletter. After you unsubscribe, your email address is deleted from the distribution list; the record of your consent is kept only as long as necessary to defend against legal claims.

14. Affiliate links

This website contains affiliate links, marked as advertising. When you click such a link, the respective partner may store a cookie or a tracking parameter in your browser in order to attribute a possible booking or purchase to this website. This processing takes place under the partner’s own responsibility and is governed by their privacy policy — I have no access to your personal data and I do not transmit any data to partners before you click.

Legal basis for placing the link itself: Art. 6 (1) (f) GDPR (legitimate interest in the financing of this website). Any cookies set by the partner after your click are subject to that partner’s own consent and privacy arrangements.

15. Social media and external links

This website does not use social media plugins, share widgets or tracking pixels from Pinterest, Meta, TikTok or any other network. Links to my profiles on those platforms are ordinary links — no data is transmitted to the platform until you actively click. Once you leave this site, the privacy policy of the respective provider applies.

16. No automated decision-making

No automated decision-making or profiling within the meaning of Art. 22 GDPR takes place on this website.

17. Children

This website is not directed at children under 16. I do not knowingly collect personal data from children. If you believe a child has provided data, please contact me and I will delete it.

18. Your rights

Under the GDPR you have the following rights regarding your personal data:

  • Access (Art. 15) — to find out whether and which data about you is processed
  • Rectification (Art. 16) — to have incorrect data corrected
  • Erasure (Art. 17) — to have your data deleted
  • Restriction of processing (Art. 18)
  • Data portability (Art. 20) — to receive your data in a machine-readable format
  • Objection (Art. 21) — to object to processing based on legitimate interests
  • Withdrawal of consent (Art. 7 (3)) — at any time, with effect for the future

19. Right to lodge a complaint

If you believe that the processing of your personal data infringes data protection law, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or the place of the alleged infringement (Art. 77 GDPR).
